My salary has not been paid in Kuwait: what do I do this week?

Your salary is late once the 7th day after its due date has passed (Art. 56). Go to the PAM labour relations unit now (Art. 146). The clock starts when your contract ends: claims your employer denies are not heard 1 year after that (Art. 144).

Official page: PAM online service page. Ask the PAM labour relations unit for your login, in person. Bring your contract and payslips.

What to do now

  1. Write down what is owed: each month, the due date, what you were paid and what is missing.
  2. Ask your employer in writing when you will be paid. Keep a copy or a screenshot of the message.
  3. Take your contract, payslips and bank statements to the PAM labour relations unit. Your leaving plan shows your last day to file.

What to ask HR

  1. When will my salary be paid?
  2. Can I have the amount owed, and how you worked it out, in writing?

When a salary counts as late

The law says monthly wages must be paid no later than the 7th day after they fall due (Art. 56). Count seven days from your pay day.

Say your salary was due on 25 January. The 7th day after is 1 February, so it is late from 2 February.

Wages include regular allowances and commissions, not only basic pay (Art. 55). List them all when you add up what you are owed.

Keep a simple record

Keep every payslip and bank statement that shows a missed or short payment. Note each date you asked about it, and who you spoke to. A clear list makes the meeting at PAM quicker. Ask for any reply in writing.

What happens at PAM

PAM calls you and your employer in and tries to settle (Art. 146). If that fails, PAM must send the case to the Court of First Instance no later than one month after you applied.

Workers pay no court fees for these claims (Art. 144).

The 1-year limit applies where your employer denies the claim. If your job has ended, file early (Art. 144).

Filing online

Ask the PAM labour relations unit for your login to the PAM online service, in person. Bring your contract and payslips.

Once you have the login, you can file the complaint and follow it online.

If your job has ended

The salary rule above covers monthly wages. For the final pay at the end of the contract, ask PAM when it is due.
