Can I leave my job without notice in the UAE?

Only by agreement with your employer, or in one of the four cases in Article 45. Otherwise you owe your employer the wage for the notice you skip (Art. 43(3)).

Get your datesEvery deadline as a date, from your last working day.

What to do now

  1. Ask your employer for a written agreement to shorten or drop the notice.
  2. If one of the Article 45 cases applies, tell MoHRE first and keep the reference.
  3. Build your leaving plan to see your final pay date.

What to ask HR

  1. Will you agree in writing to waive my notice?
  2. If not, how much notice allowance would you deduct, and how is it worked out?

By agreement

You and your employer can agree to drop the notice or shorten it. You keep your rights for the notice period (Art. 43(2)).

Put the agreement in writing, with your new last day and who pays what.

Without agreement

The side that does not keep to the notice period pays the other a notice allowance. It is owed even if the other side suffers no loss (Art. 43(3)).

The allowance is the wage for the full notice, or for the part you did not serve. It uses your last wage (Art. 43(4)).

Your employer may deduct amounts owed under the law from your gratuity (Art. 51(7)). Ask for a written breakdown if it does.

The four cases in Article 45

You may quit without notice and keep your end of service rights if:

  1. Your employer breaks its obligations to you and does not put things right. You must tell MoHRE 14 working days before you quit.
  2. Your employer assaults you, or commits violence or harassment against you. You must tell the authorities and MoHRE within 5 working days.
  3. There is grave danger at your workplace.
  4. You are given work very different from what you agreed, without your written consent.

Keep a record of each step: dates, messages and the reference MoHRE gives you.

Walking out of a fixed-term contract

Leave before your contract term ends without a lawful reason, and you may get no new work permit for 1 year (Art. 50(1)).

On probation

Probation has its own notice: 1 month to join another UAE employer, or 14 days to leave the UAE (Art. 9).

Leaving the UAE without that notice can mean no work permit for 1 year (Art. 9(6)).

Your gratuity

Resigning does not cut your gratuity, once you have 1 full year of service (Art. 51).

Leaving without notice does not change the rate either. Any notice allowance you owe is a separate amount.

Your final pay

Your employer still has 14 days from the end of the contract to pay what you are owed (Art. 53). Claims close 2 years after the job ends (Art. 54(9)).
