Leaving a job in Oman: what you're owed and by when

  • Since 31 July 2023, your gratuity is at least one month's basic pay for each year of service (Art. 61).
  • Resigning does not reduce it, and your employer must pay it as soon as the job ends (Art. 91).
  • To challenge a dismissal, complain to the Ministry of Labour within 30 days of being told (Art. 10).
  • Other unpaid dues lapse 1 year after they were due.

Your gratuity

Oman's Labour Law (Royal Decree 53/2023) came into force on 31 July 2023.

  • At least one month's basic pay for each year of service.
  • Worked out on your final basic pay.
  • Part years count in proportion.
  • No reduction for resigning.

Started before 31 July 2023? The law counts those years as service too, but does not say at what rate (Art. 61). Ask the Ministry of Labour how they are paid.

This gratuity covers workers outside the Social Protection Law, until that law's savings system starts (Art. 61). Omanis should ask the Social Protection Fund what applies to them.

A dismissal without notice on one of the grounds in Article 40 removes the gratuity. One ground is a long absence without a reason.

Probation counts towards your service if you complete it (Art. 37).

Notice and unused leave

On an open-ended contract, give 30 days' written notice if you are paid monthly, or 15 days if not. Your contract can set a longer period (Art. 38).

Pay in place of notice is based on your final gross wage.

If your employer gives you notice, you get 10 paid hours a week to look for a new job (Art. 39).

During probation, either side can end the contract with at least 7 days' notice (Art. 37).

You can leave without notice and keep your gratuity in some cases. One is wages left unpaid for more than 2 months in a row (Art. 41).

Ask the Ministry of Labour how your unused annual leave is paid out.

Final pay

Your employer must pay your wages and everything you are owed as soon as the job ends (Art. 91).

Walked out of the job on your own? Your employer has up to 7 days from the day you left.

Know your gratuity figure before the payment lands, so you can check it.

Job security allowance

Oman's job security allowance is for Omanis only (Social Protection Law, Art. 115). Expats are not covered.

Omanis apply within 12 months of the end of service. It pays 60% of the average wage over the last 2 years, for up to 6 months. The minimum is OMR 115 a month (Art. 119).

Resigning, or a disciplinary dismissal, rules it out.

Your visa

Within 60 days of the contract ending, your employer must return you to your own country or another you agree (Art. 14).

Ask your employer or the Royal Oman Police how long you may stay once your residence is cancelled. Plan your move or your new job around the answer.

If you are not paid

Start with the Ministry of Labour complaints service. See all six countries side by side.

  1. Apply to the Ministry of Labour first. A court will not accept a case filed with it directly (Art. 9).
  2. The Ministry has 30 days to settle. A settlement it records can be enforced.
  3. If it does not settle, the Ministry sends the case to court within 7 days of the last session.

Each right lapses 1 year after it was due. Your gratuity is due when the job ends, but an older unpaid wage lapses sooner.

Court fees are waived for worker claims (Art. 13). File online with the Ministry's complaint service, using your civil ID or your passport and visa details.

If a dismissal is found to be arbitrary, compensation is 3 to 12 months' gross wage. That comes on top of your gratuity and notice pay (Art. 11).
