How did Oman's gratuity change in 2023?
Since 31 July 2023, gratuity is at least one month's basic pay for each year of service (Art. 61). Years before then still count as service, but ask the Ministry of Labour at what rate they are paid.

What to ask HR
- At what rate are you paying my service before 31 July 2023?
- What final basic pay are you using?
The rate under the 2023 law
- At least a month's basic pay for each year of service.
- Worked out on your final basic pay.
- Part years count in proportion.
- No reduction for resigning.
Say your basic pay is OMR 900 and you worked 2 years, all after 31 July 2023. Your gratuity is at least 2 x OMR 900, or OMR 1,800.
Your contract can give you more than this minimum.
If you started before 31 July 2023
Article 61 says service that began before the new law counts towards your gratuity. It does not say at what rate those earlier years are paid.
So ask the Ministry of Labour how your years before 31 July 2023 are paid.
Ask HR too, and get their answer in writing. Then you can compare it with what the Ministry says.
The leaving plan works out the part of your gratuity from 31 July 2023. It tells you to ask about the years before.
Who it covers
This gratuity applies to workers not covered by the Social Protection Law, until that law's savings system starts (Art. 61).
Omanis should ask the Social Protection Fund what applies to them.
Other rules in the 2023 law
- Notice: 30 days in writing if you are paid monthly, 15 days if not (Art. 38).
- During notice from your employer, 10 paid hours a week to look for work (Art. 39).
- A dismissal complaint goes to the Ministry of Labour within 30 days of being told (Art. 10).
- Each right lapses 1 year after it was due (Art. 9).
A dismissal without notice on one of the grounds in Article 40 removes the gratuity. Resigning does not.
When you are paid
Your employer must pay your gratuity and wages as soon as the job ends (Art. 91). If you walked out on your own, it has up to 7 days from the day you left.
Unpaid gratuity can be claimed for 1 year after it was due (Art. 9).
You must apply to the Ministry first. A court will not accept a case filed with it directly (Art. 9).
Keep your contract and payslips. They show your start date and final basic pay.
