Can I leave my job without notice in Oman?

Yes, in the cases listed in Article 41, and you keep all your rights, gratuity included. Otherwise you owe your employer the notice wage, on your final gross wage (Art. 38).

What to ask HR

  1. Will you agree in writing to waive my notice?
  2. When will you pay my wages and gratuity?

The Article 41 cases

You can stop work without notice, even part way through a fixed term, and keep all your rights, if:

  • Your employer used fraud against you.
  • Your employer has not paid your wage for more than 2 months running.
  • Your employer does not meet a basic obligation under the contract or the law.
  • Your employer commits an immoral act against you.
  • Your employer assaults you.
  • Your work puts you in serious danger.

You also keep the right to claim compensation (Art. 41).

Keep evidence: bank statements showing the missing wages, messages, medical notes and police reports.

Without one of those cases

On an open-ended contract, whoever skips the notice pays the other side compensation. It equals the notice period, or the part left, on your final gross wage (Art. 38).

That means 30 days' wage on a monthly wage, 15 days' on other pay, or the longer contract period.

Your gratuity

Article 61 has no cut for resigning. Each year since 31 July 2023 earns at least a month of basic wage. Ask the Ministry of Labour at what rate years before 31 July 2023 are paid.

A dismissal on the grounds in Article 40 removes the gratuity.

One ground is absence without a lawful reason: over 7 days in a row, or over 10 separate days. The second needs a written warning first (Art. 40).

So do not simply stop turning up. Put your decision in writing.

When final pay is due

Your employer must pay as soon as the job ends. If you left the job on your own, without notice, it has up to 7 days from the day you left (Art. 91).

A better route

Ask your employer to agree an earlier last day in writing, before you stop work.

If you are not paid

Apply to the Ministry of Labour first. A court will not take the case if you skip this step (Art. 9).

The Ministry has 30 days to settle. If it cannot, it sends the case to court within 7 days of the last session (Art. 9).

You have 1 year from the day each right fell due to claim it (Art. 9). Court fees are waived for workers (Art. 13).
